So what else is new? This country itself has been ignoring the Constitution since almost before the ink dried on its signing (Check out “The Whiskey Wars”). There are more unconstitutional laws on the books that there are those that are constitutional! But nobody has, so far, come up with enough money to pay the lawyers and court costs required to get them DECLARED so. That’s one of the biggest flaws IN the Constitution: people have to VIOLATE it and “make a constitutional case” out of it before it can be resolved. There is no mechanism to make sure it IS constitutional BEFORE it can be enforced. So legislators keep on, merrily making laws with abandon, not even CARING if the laws they make are, or are not constitutional. (
